Landscape Construction for hard and soft landscaping Standard Terms and Conditions of Contract for business.



1. Payment Terms:



For jobs under $20,000

50% deposit payable as acceptance of the quote. This allows us to order the product so the price is fixed. Until the 50% deposit is received the price may increase depending on the cost of materials from our suppliers.

The remaining 50% of the invoice is due upon completion of the job.

KS Fence & Deck 2022 Limited reserve the right to withdraw from any site if any contract payment schedule is not adhered to.

Any additional changes to the job and/or costs incurred and agreed upon during the job will be charged or any less will be credited.

All Quotes are valid for 14 days.

Any amounts outstanding will incur penalty interest of 5% per week. All materials supplied by KS Fence & Deck Limited remain the property of KS Fence & Deck 2022 Limited until the payment of the work is made in full. KS Fence & Deck 2022 Limited have the rights to take back materials to the value of the amount owed if payment is not made. The client allows KS Fence & Deck 2022 Limited to enter the premises to retrieve these materials.



For jobs over $20,000

40% of the balance made by a progress payment is payable during the job. KS Fence & Deck 2022 Limited and the client will agree at what point this progress payment will be made before commencing any work. This will be agreed upon in writing either via email or text.

The remaining 10% of the invoice is due upon completion of the job.

KS Fence & Deck Limited reserve the right to withdraw from any site if any contract payment schedule is not adhered to.

2. Other Terms of Quotation/Contract:

KS Fence & Deck 2022 Limited takes no responsibility for location of boundary markers and assumes all markers are in the correct location.

Should additional Square/Lineal meter-age be required this will be set at an additional cost.

Price assumes ground is free from underground obstructions and services.

Any relocation costs and or repairs of underground services located where fencing, deck and/or retaining posts need to go, is the responsibility of the Principle Owner of the property.

All areas are to be free of building materials, general waste, excessive stone and weeds.

Price assumes KS Fence & Deck 2022 Limited will have access for light & heavy equipment and vehicles to the work site.

Price does not allow for:

a.Engineers, council or consultancy fees, permits or consents

b.Inspections conditional to final consented plans

c.Additional backfill to retaining walls

d.Removal and tipping of contaminated material

e.Traffic control

f.Temporary fencing and/or fall barriers

g.Erosion and Sediment control

h.Topsoil or fill supply

i.Drainage

j.Drainage connections

k.Service locations

l.Reestablishment of lawns or gardens

m.Plants

n.Mulching

o.Irrigation

p.Garden Maintenance



The Client can cancel the Contract with reasonable notice prior to any work commencing and in negotiation with KS Fence & Deck 2022 Limited. If the Client cancels the Contract they agree to pay any losses and costs KS Fence & Deck 2022 Limited suffers because of the cancellation. KS Fence & Deck 2022 Limited can cancel the Contract with reasonable notice and in negotiation with the Client.



3. Warranties

Due to the nature of the product KS Fence & Deck 2022 Limited use, no warranty is given on the materials. The product can be unpredictable and can warp or move due to the weather. This is out of KS Fence & Deck 2022 Limited's control and is not a workmanship error.

KS Fence & Deck 2022 Limited do stand by their workmanship. If there is a workmanship error please contact us to discuss.



Proof of Acceptance of these Terms and Conditions:

I/We understand and agree that your credit terms are as stated in this quotation. I/We understand that all goods remain the property of KS Fence & Deck 2022 Limited until quoted amount is paid in full. I/We understand any account not paid in full shall also have added to it any cost incurred with solicitors, debt collection agents and any other parties involved in the course of recovering the outstanding debt.

If this quotation is accepted please sign and return to the above address or email to info@ksfenceanddeck.co.nz along with the payment of the deposit so we can schedule the work accordingly.
